In what ways can the defendant dispute my claim?

If the defendant disputes your claim, they will send their defence to the court. They usually get 14 days to complete and return the defence by can ask to extend it to 28 days. If this happens the court will let you know.

There are various ways the defendant can dispute your claim. They can:

  • Defend all of the claim
  • Defend all the claim and claim that you owe them money (this is known as a counterclaim)
  • Admit the claim but claim that you owe them money (this is known as a counterclaim)
  • Defend part of the claim
  • Claim that they have already paid what they owe
